Terms of Service and Course Participation Agreement

1. Introduction

Welcome to Productive Struggle Institute, LLC (“PSI,” “the Institute,” “we,” “our,” or “us”).

Productive Struggle Institute exists to help learners, teachers, and leaders grow through challenge, reflection, and intentional practice. Participation in PSI programs requires respect for fellow learners, respect for intellectual property, personal responsibility for one’s actions, and a commitment to ethical conduct.

These Terms of Service and Course Participation Agreement (“Terms”) govern access to and use of PSI websites, courses, videos, downloads, assessments, resources, live sessions, digital communities, coaching experiences, and related educational materials.

By purchasing, enrolling in, accessing, or participating in any PSI program, the participant agrees to these Terms.

If the participant is under the age of 18, a parent or legal guardian must review and accept these Terms on the participant’s behalf.

2. Acceptance of Terms

By creating an account, purchasing a course, accessing course materials, attending a live session, downloading resources, submitting forms, or checking an acknowledgment box, the participant agrees to comply with these Terms.

PSI may require electronic acknowledgment of these Terms, the Privacy Policy, Intellectual Property and Acceptable Use Policy, Protection of Minors Policy, Community and Professional Conduct Standards, and any course-specific requirements before course access is granted.

Electronic records and signatures are generally recognized under the federal E-Sign Act when legal requirements for consent and electronic records are satisfied.

3. Electronic Acknowledgment and Recordkeeping

PSI may use electronic acknowledgment systems to document participant agreement.

A completed acknowledgment may include:

• Participant name
• Parent or guardian name, when applicable
• Email address
• Course or program name
• Date and time of acknowledgment
• Version of the agreement accepted

By checking an acknowledgment box or submitting an electronic agreement form, the participant confirms that the participant has reviewed, understands, and agrees to the applicable PSI policies.

4. Course Access and Account Use

Course access is granted only to the enrolled participant unless PSI provides written permission for shared household access or limited beta review.

Participants may not:

• Share login credentials with unauthorized users
• Copy, download, reproduce, distribute, resell, or publicly display PSI materials
• Use PSI materials to create a competing course, training, or instructional product
• Circumvent payment, access controls, or course restrictions
• Misrepresent PSI materials as their own work
• Use PSI content in a way that violates these Terms or harms the Institute

PSI may suspend or terminate access if a participant violates these Terms.

5. Educational Purpose and No Guarantee of Results

PSI provides educational instruction, professional development, learning frameworks, strategies, tools, and resources.

PSI does not guarantee:

• A specific SAT score
• Admission to any college or university
• Academic performance outcomes
• Certification outcomes beyond PSI-issued completion documentation
• Employment opportunities
• Business income
• Professional advancement
• Personal transformation

Learning outcomes depend on participation, practice, effort, application, prior knowledge, and individual circumstances.

The purpose of PSI instruction is to support growth, reflection, independence, and informed practice.

6. Extreme SAT Course Terms

Extreme SAT is an educational program designed to help students understand how SAT questions are built, recognize patterns, apply strategies, and practice with greater purpose.

Extreme SAT may use examples, practice materials, instructional analysis, and released educational content to teach reasoning, pattern recognition, and test awareness.

Extreme SAT is not affiliated with, endorsed by, or sponsored by College Board unless expressly stated in writing.

Students and families understand that PSI does not guarantee a specific score increase or testing outcome.

Parents or legal guardians remain responsible for determining whether a minor student is ready to participate in the course and for supporting appropriate use of the course.

7. Protection of Minors

PSI may serve minors through educational programs such as Extreme SAT.

Parents or legal guardians are responsible for:

• Reviewing course expectations
• Providing consent for minors to participate
• Supervising appropriate use of course materials
• Managing student account access
• Communicating with PSI when support is needed

PSI does not knowingly collect more information from minors than is reasonably necessary to provide course access, instruction, support, and program improvement.

For children under 13, additional legal requirements may apply. The Children’s Online Privacy Protection Act, known as COPPA, applies to websites or online services directed to children under 13 and to operators with actual knowledge that they are collecting personal information from children under 13.

PSI does not sell student data and does not share student data with outside organizations for research purposes.

8. Privacy and Data Use

PSI may collect information necessary to provide access to courses and services, including:

• Name
• Email address
• Purchase information
• Course progress
• Assessment responses
• Survey responses
• Communication records
• Participation data

PSI uses information to:

• Provide course access
• Process payments
• Communicate with participants
• Support learning
• Improve course design
• Maintain business records
• Protect the integrity of PSI programs

PSI does not sell participant data.

PSI does not share participant information with outside organizations for research purposes.

9. Intellectual Property and Asteya

PSI encourages participants to learn from course materials, apply concepts, adapt ideas ethically, and create original work.

However, all PSI materials remain the intellectual property of Productive Struggle Institute, LLC unless otherwise stated.

Protected materials include, but are not limited to:

• Curriculum
• Videos
• Slides
• Assessments
• Downloads
• Observation protocols
• Reflection frameworks
• Coaching tools
• Course structures
• Teaching methodologies
• Productive Struggle Teaching Arc
• Extreme SAT instructional framework
• Yoga Coach training materials
• Branding, logos, slogans, and course names

Participants may use what they learn to improve their own thinking, teaching, coaching, writing, studying, leadership, and professional practice.

Participants may not copy, reproduce, distribute, sell, repackage, teach, publish, upload, license, or present PSI materials or frameworks as their own.

PSI expects participants to practice intellectual honesty and Asteya, the principle of non-stealing. Participants may learn from PSI materials and create original work inspired by their learning, but they may not take PSI materials, structures, language, methods, or resources and represent them as their own.

Learning from the work is encouraged.

Stealing the work is not permitted.

10. Responsible Representation of PSI

Completion of a PSI course does not create employment, partnership, agency, franchise, endorsement, contractor status, trainer status, or authorization to represent PSI.

Participants may not:

• Claim to be employed by PSI unless formally hired
• Claim to be an authorized PSI trainer unless formally approved in writing
• Use PSI logos, branding, or course names without written permission
• Market courses, services, or materials in a way that implies PSI endorsement without written permission
• Misrepresent their relationship with PSI

Participants who complete PSI programs may accurately describe their completion status, provided the description is truthful and not misleading.

11. Yoga Coach Program Terms

Yoga Coach programs are educational and professional-development programs for yoga teachers and related professionals.

Yoga Coach programs may include:

• Movement practice
• Breathwork
• Meditation
• Professional reflection
• Coaching practice
• Peer observation
• Practicum experiences
• Live Zoom sessions
• Discussion and feedback
• Downloadable protocols and resources

Participants understand that movement-based education carries inherent risks. Online fitness and yoga waiver guidance commonly emphasizes that participants should understand risk, assume personal responsibility, and recognize where participant responsibility begins.

By participating in Yoga Coach programs, participants agree to:

• Listen to their bodies
• Modify practices as needed
• Stop if experiencing pain, dizziness, distress, or unsafe conditions
• Seek medical or professional guidance when appropriate
• Practice within their own limits
• Maintain a safe physical practice environment

PSI does not provide medical advice, diagnosis, treatment, physical therapy, psychotherapy, or emergency care.

Participation is voluntary.

Participants remain responsible for their own bodies, choices, modifications, and learning environment.

12. Live Sessions, Zoom Participation, and Recordings

PSI may offer live sessions through platforms such as Zoom or other online meeting tools.

Participants are responsible for:

• Maintaining appropriate technology access
• Joining sessions on time
• Participating respectfully
• Protecting the privacy of other participants
• Using breakout rooms professionally
• Following instructor directions
• Maintaining a safe physical environment during movement-based activities

PSI may record live sessions for instructional, review, or enrolled-participant access purposes.

Participants may not record, copy, download, distribute, or share PSI live sessions or recordings without written permission.

13. Community and Professional Conduct

PSI learning environments are built on respect, reflection, and ethical participation.

Participants agree to:

• Communicate respectfully
• Offer constructive feedback
• Maintain confidentiality when appropriate
• Avoid harassment, intimidation, discrimination, or humiliation
• Respect professional boundaries
• Participate in good faith
• Support a culture of growth and accountability

Feedback in PSI programs should be used to promote growth, not shame.

Participants who violate conduct expectations may be removed from a course, live session, community, or program without refund, when appropriate.

14. Payments, Enrollment, Refunds, and Cancellations

 

Payment, enrollment, refund, cancellation, transfer, and credit policies may vary by course, program, service, or coaching experience. Any course-specific or service-specific refund policy presented at checkout, in an invoice, in an offer page, or in program materials becomes part of these Terms.

 

Extreme SAT

Extreme SAT is a digital educational course. Because participants receive access to digital instructional materials, videos, downloads, assessments, strategies, and course resources after enrollment, all Extreme SAT purchases are final unless otherwise stated in writing at checkout.

 

PSI does not guarantee a specific SAT score, academic outcome, college admission result, scholarship result, or testing performance. Students and families are responsible for reviewing course descriptions, requirements, and expectations before purchase.

 

No refunds are issued for Extreme SAT once course access has been granted, except where required by law or where PSI expressly states a different refund policy in writing.

 

Beta Access, Free Access, and Complimentary Review Access

PSI may provide beta access, free access, complimentary access, or limited review access to certain participants. Free or complimentary access has no cash value and is not refundable, transferable, or redeemable for credit unless PSI states otherwise in writing.

 

Yoga Coach 300 Hour Training

For Yoga Coach 300 Hour Training, PSI’s attached refund policy states that a $100 non-refundable registration fee is required upon acceptance and that a total deposit of $500 secures the participant’s space in the program.

 

The remaining balance is invoiced four weeks before the start date, must be paid in full two weeks before training begins, and course access is granted upon full payment.

 

If a participant withdraws more than seven days before training begins, the $100 registration fee is non-refundable, and additional payments may be transferred one time to a future training within six months.

 

If a participant cancels within seven days of the training start date, no refunds are issued, though a one-time credit may be issued at the program director’s discretion if the training is fully enrolled and the space can be filled from a waitlist.

 

Once the training has begun, no refunds, credits, or transfers are issued under any circumstances.

 

PSI reserves the right to cancel or reschedule training before the start date. If PSI cancels or reschedules training before the start date, all payments made directly to PSI for that training will be refunded in full. PSI is not responsible for travel, lodging, scheduling, lost wages, or other external expenses.

 

Coaching Services, Consulting, and Leadership Coaching

PSI may offer coaching, consulting, leadership development, program design support, yoga school launch coaching, curriculum review, or other professional services.

 

Coaching and consulting services are not refundable once purchased, scheduled, delivered, or partially delivered unless PSI states otherwise in writing. This includes, but is not limited to, one-on-one coaching, group coaching, leadership coaching, yoga school launch coaching, curriculum design support, program review, and professional consultation.

 

If a participant or client misses a scheduled coaching session, cancels late, fails to attend, or does not use purchased coaching services, PSI is not required to issue a refund, credit, or replacement session. PSI may allow rescheduling at its discretion when reasonable notice is provided.

 

Coaching and consulting services are educational and developmental in nature. PSI does not guarantee business income, school approval, certification approval, professional advancement, employment, client acquisition, student enrollment, leadership outcomes, or personal transformation.

 

Payment Plans and Failed Payments

If PSI offers a payment plan, the participant remains responsible for all scheduled payments unless PSI states otherwise in writing. Failure to complete required payments may result in suspension or termination of course access, coaching access, certificates, services, or other program benefits.

Chargebacks and Payment Disputes

Participants agree to contact PSI first with any billing concern before initiating a chargeback or payment dispute. PSI reserves the right to suspend or terminate access during unresolved payment disputes.

Required Refunds

Nothing in this policy is intended to limit any refund, cancellation, or consumer protection right that cannot legally be waived.

15. Course-Specific Requirements

Certain PSI programs may include additional requirements.

Extreme SAT may include:

• Parent or guardian acknowledgment for minors
• Baseline assessment recommendations
• Practice expectations
• Educational data review
• Course reflection surveys

Yoga Coach programs may include:

• Attendance requirements
• Practicum participation
• Peer observation
• Professional conduct expectations
• Completion requirements
• Certificate eligibility requirements
• Yoga Alliance or YACEP-related reporting guidance when applicable

Participants are responsible for reviewing and following course-specific requirements.

16. Certificates and Completion Documentation

PSI may issue certificates of completion when participants meet applicable course requirements.

A certificate of completion confirms completion of PSI program requirements.

A certificate does not guarantee:

• Employment
• Professional licensing
• Yoga Alliance status
• Teaching approval from another organization
• Income
• Business success
• Authorization to represent PSI

Participants are responsible for submitting any required documentation to outside organizations when applicable.

17. Limitation of Liability

To the fullest extent permitted by law, PSI is not responsible for indirect, incidental, consequential, special, punitive, or exemplary damages arising from participation in PSI programs, use of PSI materials, inability to access services, technical issues, learning outcomes, personal decisions, or third-party services.

Participants are responsible for their own choices, participation, technology, learning environment, physical environment, and application of course materials.

Nothing in these Terms is intended to limit obligations that cannot legally be limited.

18. Third-Party Platforms and Services

PSI may use third-party platforms such as Kajabi, Zoom, payment processors, email services, file-hosting tools, and related technology providers.

PSI is not responsible for outages, policies, errors, changes, or limitations of third-party platforms.

Participants may be required to follow the terms and policies of third-party platforms used to deliver PSI services.

19. Termination or Restriction of Access

PSI may suspend, restrict, or terminate access if a participant:

• Violates these Terms
• Shares login credentials without permission
• Copies or distributes PSI materials
• Harasses or mistreats others
• Misrepresents PSI affiliation
• Uses PSI materials to create competing products
• Fails to meet payment obligations
• Acts in a way that compromises safety, privacy, or program integrity

Termination may occur without refund when the violation is serious or harmful.

20. Changes to Terms

PSI may update these Terms as programs, services, laws, platforms, or business operations change.

Updated Terms will include a revised effective date or version number.

Continued use of PSI services after updated Terms are posted or acknowledged means the participant accepts the updated Terms.

For major updates, PSI may require renewed acknowledgment.

21. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
